Análisis comparativo de los regímenes de gobierno totalitario y democrático. Caso de estudio: España

Abstract

Historically, to protect and guarantee human rights and freedoms of the governed, it has been necessary to limit power. Considering that the main way to achieve the maximum degree of well-being and human dignity will be through democracy. Democracy should not only be understood as a political figure or institution within the State, by itself, democracy establishes the basis of the legal framework. Based on the above, this research starts with the origins of the State and its first organizational forms (Rule of Law and Constitutional State). In this respect, in the proposed work the narrative and argumentative landscape are presented to take the reader to a scenario on the origins and bases of the State. A starting point is presented that allows us to identify two forms of government, the object of this study, is the monarchical (totalitarian) model and the democratic one. It must be kept in mind that every State arises from the imposition of monarchical models, which are given by the processes of conquest. Hence, this research seeks to analyze how Spain and Mexico have adopted and adopted totalitarian models throughout their history. However, through social struggles, these countries have transitioned to democratic models whose basis is society. Likewise, this research studies how society has become an important part of the decision-making process of a country; especially important to achieve the highest possible degree of well-being and dignity, individually and collectively, concerning the legal sphere of the governed.

Históricamente, para proteger y garantizar los derechos y las libertades humanas de las y los gobernados, ha sido necesario limitar al poder. Considerando que la principal vía para lograr alcanzar el máximo grado de bienestar y dignificación humana será mediante la democracia. La democracia no sólo debe ser entendida como una figura o institución política dentro del Estado, en sí misma, la democracia establece las bases del marco jurídico. Con base en lo anterior, la presente investigación parte de los orígenes del Estado y de sus primeras formas organizacionales (Estado de Derecho y Estado Constitucional). En este orden de ideas, en el trabajo propuesto se presentan el paisaje narrativo y el argumentativo con el fin de llevar al lector a un escenario sobre los orígenes y bases del Estado. Se expone un punto de partida que permita identificar dos formas de gobierno, objeto de este estudio, el modelo monárquico (totalitario) y el democrático. Se debe tener presente que todo Estado surge a partir de la imposición de los modelos monárquicos, mismos que se dan por los procesos de conquista. En la presente investigación, se busca analizar cómo España y México han pasado y adoptado, a lo largo de su historia, modelos totalitarios. Sin embargo, a través de las luchas sociales, estos países han transitado a modelos democráticos cuya base es la sociedad. De igual manera, en esta investigación se estudia cómo la sociedad ha llegado a ser parte importante en el proceso de toma de decisiones de un país; especialmente importante para lograr alcanzar el máximo grado posible de bienestar y dignificación, en lo individual y en lo colectivo, en lo que respecta a la esfera jurídica de las y los gobernados.
