Las pensiones por riesgo de trabajo en México: análisis desde una perspectiva interseccional sobre su inconstitucionalidad

Abstract

Occupational risk pensions fulfill one of the primary objectives of social security, which is to guarantee the means of subsistence to the worker who has found himself in this situation. This social security benefit rests on the constitutional principle of employer responsibility for work risks; However, as noted in the content of this research work, derived from the analysis of national legislation on the matter and the comparative study of the pension system in Chile, it is maintained that said principle has been violated to the detriment of the working class in Mexico, since the reform of the Social Security Law of 1997.

Las pensiones por riesgo de trabajo cumplen con uno de los objetivos de la seguridad social primordiales, como lo es, el de garantizar los medios de subsistencia al trabajador que se haya encontrado en ese supuesto. Esa prestación de seguridad social, descansa sobre el principio constitucional de la responsabilidad patronal ante los riesgos de trabajo; sin embargo, como se advierte del contenido de este trabajo de investigación, derivado del análisis de la legislación nacional en la materia y el estudio comparativo del sistema pensionario en Chile, se sostiene que dicho principio se ha visto vulnerado en perjuicio de la clase obrera en México, a partir de la reforma a la Ley del Seguro Social de 1997.
