Justicia ambiental como requisito indispensable para la consolidación del derecho a un medio ambiente sano

Abstract

Although the right to a healthy environment is a fundamental right recognized by our Constitution, it is necessary to have effective guarantees to achieve its full realization. These guarantees include, in the foreground, the institutions, programs, secondary laws and other devices necessary to give content to what is prescribed by the constitutional norm. Likewise, it is necessary that they include procedural mechanisms for their defense and effective compliance. In this sense, talking about environmental justice would imply thinking about an effective judicial remedy and procedural mechanisms to defend the content of article 4.

Aunque el derecho a un medio ambiente sano sea un derecho fundamental reconocido por nuestra Constitución, es necesario contar con garantías efectivas para lograr su total realización. Dichas garantías incluyen, en un primer plano, a las instituciones, programas, leyes secundarias y demás dispositivos necesarios para dar contenido a lo preceptuado por la norma constitucional. Así también, es necesario que incluyan los mecanismos procesales para su defensa y efectivo cumplimiento. En este sentido, hablar de justicia ambiental implicaría pensar en un recurso judicial efectivo y mecanismos procedimentales para defender el contenido del artículo 4°.
