La dignidad humana y el principio pro persona como parámetro de aplicación del control de constitucionalidad y convencionalidad

Abstract

The following essay talks about the importance of two major current issues and sufficient importance to modern times, we talk about human dignity and the principle pro person, which have emerged in the legal world and modern constitutionalism. Also called by some jurists "the era of human rights" where they face each other under international law and the domestic law of each country. In this context particular emphasis on the concept and importance of human dignity to man, and the obligation arises for the state and society to respect and ensure it is done. Likewise the first person pro as the best alternative interpretation for the protection of human rights and human dignity is analyzed

El presente trabajo nos habla sobre la importancia de dos grandes temas de actualidad y basta importancia para los tiempos modernos, hablamos de la dignidad humana y el principio pro persona, los cuales han resurgido en el mundo jurídico y del constitucionalismo moderno. También llamado por algunos juristas “la era de los derechos humanos”, donde se encuentran frente a frente el derecho internacional y el derecho local de cada país. En este contexto se hace particular énfasis en el concepto y la importancia que tiene la dignidad humana para el hombre, y la obligación que surge para el Estado y la sociedad en respetarla, y garantizarla. Así mismo se analiza el principio pro persona como la mejor alternativa de interpretación para la protección de los derechos y dignidad humana.
