Control de constitucionalidad a priori para las reformas constitucionales: caso Michoacán

Abstract

The control of constitutionality is one of the mechanisms most developed by the doctrine, and that historically has been present in a universe of constitutional texts of each society, since this is the basis for constitutional reforms, and that part of the variant, in how flexible or rigid is such process. Therefore, the present work establishes the progress that has been made in the ways to modify the Constitutions both at the federal level and in the particular case of Michoacán, taking as an analysis the cases of Spain and Chile that served to expand the vision on the current mechanism of modification to the superior text, this, focused on the local level. Finally, the advantages that the changes to the procedure for the Constitution of the State of Michoacán de Ocampo can bring about are presented.

El control de constitucionalidad es uno de los mecanismos más desarrollados por la doctrina, y que históricamente ha estado presente en un universo de textos constitucionales de cada sociedad, ya que este es la base para efectuar las reformas constitucionales, y que parte de la variante, en que tan flexible o rígido es dicho proceso. Por lo cual el presente trabajo establece el progreso que se ha tenido a las formas para modificar las Constituciones tanto a nivel federal, como en el caso particular de Michoacán, tomando como análisis los casos de España y Chile que sirvieron para ampliar la visión sobre el mecanismo actual de modificación al texto superior, esto, enfocado en el ámbito local. Finalmente, se lograr presentar las ventajas que puede traer consigo, los cambios al procedimiento hacia la Constitución del Estado de Michoacán de Ocampo.
