La tutela judicial en México: ¿efectiva?

Abstract

In Mexico (Country and Michoacán) judicial protection is effective? The questioning is made because, from time to time, a restructuring of the Mexican legal system has arisen, which makes us question whether these reforms represent a real advance in the delivery of justice, or if they are insufficient before the structure inefficient and worn out institutional, then, this research is to get to know, what are the main problems of the current model of justice. The present research work is approached through an analysis of the historical reality of the country, and its assimilation by the State, in order to understand the processes that our culture has faced, from various historical movements such as Independence, Revolution and the consolidation of the Mexican State, which makes us suppose the adoption of a foreign thought, identified with domination. The sociopolitical perspective allows us to make a critique of the economic model, the inequitable distribution of wealth, poverty and development, understanding the way it favors oligarchies and the materialization of a model of technocratic justice, selective and exclusive, very far away of social reality and the demands of justice. Finally, the subject of judicial protection will be addressed, from within, to understand its structure, legitimacy and systems of contestation, which will allow us to identify its ineffectiveness, to propose measures that achieve its optimization.

¿En México (País y Michoacán) la tutela judicial es efectiva? El cuestionamiento se hace en atención a que, de un tiempo a la fecha, se ha suscitado una restructuración al sistema jurídico mexicano, que nos hace cuestionarnos si dichas reformas representan un avance real en la impartición de justicia, o si resultan insuficientes ante la estructura institucional ineficiente y desgastada, luego entonces, en investigación se pretende llegar a saber, cuales son las principales problemáticas del modelo de justicia actual. El presente trabajo de investigación se aborda a través de un análisis de la realidad histórica del país, y su asimilación por el Estado, con el fin de entender los procesos que ha enfrentado nuestra cultura, a partir de diversos movimientos históricos como la Independencia, la Revolución y la consolidación del Estado mexicano, que nos hace suponer la adopción de un pensamiento ajeno, identificado con la dominación. La perspectiva sociopolítica nos permite realizar una crítica al modelo económico, la inequitativa distribución de la riqueza, la pobreza y el desarrollo, entendiendo la forma en que favorece a las oligarquías y a la materialización de un modelo de justicia tecnócrata, selectivo y excluyente, muy alejado de la realidad social y de los reclamos de justicia. Finalmente, se abordará el tema de la tutela judicial, desde adentro, para entender su estructura, legitimación y sistemas de impugnación, lo que nos permitirá identificar su inefectividad, para proponer medidas que logren su optimización.
