Gastos y costas en juicios administrativos de Michoacán, limitante a particulares del acceso a la justicia

Abstract

The evolution of Administrative Law in Mexico, specifically in Michoacan has been remarkable in recent years. Significantly more resources have been provided to the citizens so they can enforce their rights against the State, mainly the Right to Justice. However, legal expenses limit individuals in exercising their rights. Even when citizens obtain a favorable resolution in Court, they will not be able to recover the expenses incurred, according to the provisions of the Code of Administrative Justice for the State. Hence, performing an analysis of the Spanish legislation, in which court fees and costs are established differently, will allow consideration for new alternatives that will guarantee Michoacan citizens due access to Administrative Justice.

La evolución del Derecho Administrativo en México, específicamente en Michoacán ha sido notable en los últimos años, cada vez se otorgan más recursos a los ciudadanos para hacer valer sus derechos frente al Estado, principalmente el Derecho a la Justicia, sin embargo, encontramos en los Gastos y Costas judiciales, una limitante para ejercerlo, ya que el ciudadano, aun y cuando acuda al Tribunal y obtenga resolución favorable, no podrá recuperar los gastos realizados, según lo dispuesto por el Código de Justicia Administrativa para el Estado. En ese sentido, al analizar la legislación de España donde la figura de los Gastos y Costas se establece de manera diferente, esto permitirá buscar alternativas para garantizar a los ciudadanos Michoacanos un debido acceso a la Justicia Administrativa.
