Derecho energético, políticas públicas y evaluación del impacto social en proyectos de energía renovable

Abstract

This thesis, entitled "Energy Law, Public Policies and Evaluation of the Social Impact on Renewable Energy Projects" is part of an investigation into the impact generated by the Assessment of The Social Impact on renewable energy projects, which materializes in both positive and negative impacts, which are linked to the law in terms of the normative that regulates this concept. At the same time, it generates the contemporary criteria for interpretation by the courts and points out the conduct that will eventually affect in a positive or negative way the surrounding communities where renewable energy projects are generated that will eventually define the direction and strengthening of public policies that will impact society. The axes of the development work over four chapters in which the concepts identified in the research title were analyzed, in order to finish by checking a working hypothesis. Thus, the focus of this research is on the analysis of whether the Social Impact Assessment strengthens public policies that positively impact communities close to technological developments where renewable energy is used.

La presente tesis, titulada “Derecho Energético, Políticas Públicas y Evaluación del Impacto Social en Proyectos de Energía Renovable” se enmarca en una investigación sobre el impacto que genera la Evaluación del Impacto Social a los proyectos de energía renovable, que se materializa tanto en impactos positivos como negativos, que vinculados al derecho por cuanto a la normativo que regula este concepto. A la vez genera los criterios contemporáneos para su interpretación, por los órganos jurisdiccionales y señalan las conductas que terminarán por afectar de manera positiva o negativa a las comunidades aledañas a dónde se generen proyectos de energía renovable que terminarán por definir el rumbo y el fortalecimiento de las políticas públicas que impactarán a la sociedad. Los ejes del trabajo de desarrollo a lo largo de cuatro capítulos en los que se analizaran, los conceptos señalados en el título de la investigación, para terminar por comprobar una hipótesis de trabajo. Así pues, el objeto de estudio de esta investigación es sobre el análisis de si la Evaluación del Impacto Social, permite fortalecer a las políticas públicas que impacten de manera positiva a las comunidades cercanas a los desarrollos tecnológicos en los que se utilizan energías renovables.
