Educación de calidad, justiciabilidad de un derecho fundamental. El caso Michoacán

Abstract

This research explores the way of make justiciable the fundamental human right to get a quality education in Michoacan where frequently there are many violations to this right conceived as the right to learn. For that, it is performed a study of the education as a social process and system, its fundamental contents stablished in the Constitution and international instruments; also it is performed a comparative law exercise of the normative regulation and judicial protection regime in Spain and it is examined the parameters that indicate the compliance or noncompliance of this right through the “four A” international system of indicators, to be able to go to the systems of international , regional and national justice in cases of violation.

Este trabajo de investigación explora la manera de hacer justiciable el derecho humano fundamental a una educación de calidad por parte de la sociedad michoacana, en donde existen violaciones recurrentes a este derecho, concebido como el derecho a aprender. Para ello, se realiza un estudio de la educación como proceso y sistema social, de sus contenidos fundamentales como un derecho establecido en la Constitución y en tratados internacionales; también se realiza un ejercicio de derecho comparado de la regulación normativa y régimen de protección judicial en España, y se examinan los parámetros que indican el cumplimiento o incumplimiento de este derecho a través del esquema internacional de indicadores de las “cuatro A”, para estar en condiciones de acudir a los sistemas de justicia internacional, regional y nacional en caso de violación.
