La facultad del Estado Mexicano para clasificar información como reservada por motivos de seguridad nacional

Abstract

Through this investigation work, it was analyzed the situation of restricted access information for national security reserves as well as a ponderation of human rights in front of national security, but even more against the movements and interests of those who are in charge of the obligated subjects. Spain is chosen as the ideal country offering a brief development of its operation because it is the country that has served as a model for our nation, of that from which we have copied multiple parts of our legal system. Finally, a thorough critique is made of the current system used by the INAI through the National Transparency Platform, and the system of reserved indexes of the Institute itself.

En este trabajo de investigación se realiza un análisis de la situación de acceso restringido a la información por reservas de seguridad nacional, así como una ponderación de los derechos humanos frente a la misma seguridad nacional, pero más aún frente a los movimientos e intereses de quienes se encuentran al frente de los sujetos obligados. Se elige a España, como país ideal ofreciendo un breve desarrollo de su funcionamiento por ser el país que ha servido de ejemplo para nuestra nación, o bien, aquel del que se han copiado múltiples partes del sistema jurídico. Por último, se realiza una crítica exhaustiva al sistema actual que emplea el INAI a través Plataforma Nacional de Transparencia, y al sistema de índices reservados del mismo Instituto.
