Mecanismos para la protección, garantía y defensa de los derechos humanos laborales de las mujeres en México. Un recorrido histórico

Abstract

The mechanisms for the protection, guarantee and defense of the labor human rights of women, allow the Mexican State to comply with its commitments assumed in article 1 of the Constitution, both nationally and internationally, and thereby guarantee the effective enjoyment of labor human rights in that sector. In this way and considering that women continue to be the object of different affectations in terms of work, within this research the main objective is to carry out a historical study about the mechanisms implemented by the Mexican State for the protection, guarantee and defense of labor human rights of women. To achieve the above, a methodology with a historical approach was proposed, using legal, descriptive, synthetic and analytical methods that allowed the development of this investigation. According to the study carried out, it is concluded that there are national and international regulations that seek the guarantee, respect and protection of the labor human rights of women, in the same way there is the implementation of public policies that contribute to the fulfillment of their obligations contained in the basic ordering.

Los mecanismos para la protección, garantía y defensa de los derechos humanos laborales de las mujeres, permiten que el Estado mexicano cumpla con sus compromisos asumidos en el artículo 1° constitucional, tanto en el ámbito nacional como en el internacional, y con ello se garantice el goce efectivo de los derechos humanos laborales de dicho sector. De esta manera y atendiendo a que las mujeres siguen siendo objeto de distintas afectaciones en materia de trabajo, dentro de esta investigación se plantea como objetivo principal realizar un estudio de corte histórico acerca de los mecanismos implementados por el Estado mexicano para la protección, garantía y defensa de los derechos humanos laborales de las mujeres. Para lograr lo anterior, se planteó una metodología con un enfoque histórico, utilizando los métodos jurídico, descriptivo, sintético y analítico que permitieron el desarrollo de la presente investigación. De acuerdo al estudio realizado, se concluye que existe normativa nacional e internacional que procura la garantía, respeto y protección de los derechos humanos laborales de las mujeres, de igual forma existe la implementación de políticas públicas que contribuyen al cumplimiento de sus obligaciones contenidas en el ordenamiento fundamental.
